Exceptional case funding for inquests will no longer be means tested

The Government has announced that Exceptional Case Funding (ECF) for inquests will no longer be means tested from 12 January 2022.

This means that families in Article 2 inquests will no longer have to undergo the often long, complicated and intrusive process of assessing their financial situation before being granted funding for legal representation. It could be seen as the first step in the Government addressing the current imbalance in funding between families who are often left unrepresented if they cannot pay privately and state institutions (that may be responsible for the death) who are able to instruct solicitors and barristers using public funds.
