Summary: Judgment of Baker J refusing the mother’s application for permission to take her two sons to China for a holiday. The two subject children were aged 8½ and 6. The father had dual UK and Australian nationality. Their mother was a Chinese national but had recently acquired a British passport. Both D and B held dual British and Australian citizenship. Neither child held Chinese citizenship.
