Prof Roy Light acted for Murco Petroleum before the licensing committee and in the Administrative Court. The decision in R (on the application of) Murco Petroleum Limited v Bristol City Council [2010] EWHC 1992 (Admin), reported in the October 2010 issue of Licensing Review ([83] 19-25), has introduced some uncertainty into the operation of s.176 Licensing Act 2003 in respect of the sale of alcohol from premises at which ‘garage use’ takes place. Before considering s.176 and the Murco decision it is instructive briefly to consider the background to the section.
