Tim Leader appeared for Dartmoor National Park Authority in the Court of Appeal, having represented the Authority in the High Court during 2021. The High Court decision case report can be found here.
In the Court of Appeal, Tim was against Andrew Fraser Urquhart KC.
This was a successful and legally significant Court of Appeal case of national importance. It relates to a caravan park (known as the Magpie Leisure Park) and the rejection of the planning permission needed for 80 caravans for human habitation.
The case explored the law on the interpretation of planning permissions, the distinction between the principle in I’m your Man Limited and planning cases involving a material change of use of land and intensification.
