Ben represented the Claimant, a pedestrian in his 60s struck by a car while walking along a country lane, in a £5m+ catastrophic injury claim.

He sustained a severe traumatic brain injury with a full spectrum of capacity, vision, speech, and mobility issues making him reliant on 24/7 professional care for life.

Contributory negligence was alleged, and causation and quantum were strongly disputed. 15 different expert specialisms were required to provide evidence, including neurology, neuropsychology, ophthalmology, forensic accident reconstruction and (unusually) biomechanics evidence to determine which way the Claimant was facing, as he had no recollection of the collision.

The claim settled for just under £4m shortly after JSM in June 2024, enabling C to move into a specially adapted home in a picturesque location very near his previous house, and afford the ongoing package of specialist care, therapies, aids and equipment he so desperately needed.
