The claimant was admitted to the defendant hospital displaying severe psychiatric symptomatology. It was noted that he was abusive and intimidating towards others. He was placed on an intensive care unit intended for patients in an acutely disturbed phase of mental disorder and nursed on a 2:1 basis.
Despite this he was punched by another patient who he had antagonised. The claimant’s nose was broken and he required cosmetic surgical input the cost of which was provided as an interim payment before compromise of the claim.
