W v Cavern City

The claimant was at the defendants’ public house with her partner. Without provocation her partner was punched by a man at the pub. In the ensuing scuffle the claimant and her partner were ejected from the pub. The claimant returned to the pub to collect her belongings when she slipped on spilt drinks fracturing her right mandible, right radius and ulna and sustaining a head injury. Liability was denied. The whole sequence of events was captured on CCTV and the claim settled.
