Charles is instructed on all aspects of property law litigation and takes a particular interest in real property matters including those concerning: boundaries, easements, trusts of land, proprietary estoppel and restrictive covenants. He is experienced in leasehold-specific disputes such as those relating to service charges, leasehold covenants and forfeiture. He also frequently deals with property matters that contain a tortious elements such as trespass and nuisance.

Charles acts for landlords and tenants in disputes arising from residential and commercial leases. He is instructed across a full range of such disputes including: possession proceedings, contested commercial lease renewals, claims for disrepair, applications for housing-related injunctions and committals.

Recent cases include:

  • A long-running neighbour dispute with inter-related tortious, boundary and right of way issues.
  • No-fault possession proceedings defended on the basis of proprietary estoppel and constructive trust analysis.
  • Claim concerning alleged mistake in the context of registered conveyancing.
  • Contested boundary dispute concerning the presence of informal boundary agreements.
  • Application to determine the reasonableness of service charges levied under the terms of a residential long lease.
  • Advising on the presence of various implied easements in an agricultural-residential setting.
  • Claim in nuisance in the context of contested repairing/settlement agreements.
  • Contested application before the First-Tier Tribunal (Property Chamber) for the determination of exact boundaries under r. 118 of the Land Registration Rules 2003.
  • Advising on enforceability of various freehold covenants in respect of high-value commercial land.
